New roofing law aimed at protecting consumers

Published 5/18/2013 in Business : Business

rcampbell@gctelegram.com

Come July 1, not everyone will be able to hang out a shingle and call themselves a roofing contractor.

A new state law, called the Kansas Roofing Contractor Registration Act will require residential and commercial roofing contractors to register with the state. The law is aimed at protecting Kansas home and building owners from “unscrupulous activity,” especially after a severe storm, DV Douglass Roofing co-owner and Kansas Roofing Association President Steve Douglass said in a press release.

The law will become part of the Consumer Protection Act, which is administered and enforced by the Attorney General. It also will create a registry in the Office of the Attorney General.

Douglass, who co-owns Douglass Roofing with his three brothers, said the law closes a “doughnut hole” in the Midwest, with Kansas being the only state without a roofing contractor registration law. The law applies to contractors statewide, as well as those from out of state.

“Every roofing contractor, regardless, will have to register,” Douglass said. There are a few exceptions such as if someone is repair their own roof, or there is a handyman exemption where someone adding a room onto a home and tacking on a “few shingles” wouldn’t have to register.

“That’s what we as the Kansas Roofing Association have requested that everyone starts from scratch and registers,” Douglass said. He said Kansas loses $2 million a year in sales tax from contractors who come in and bring materials from out of state.

“This will help ensure these guys are paying the same as the one in Kansas and help protect the elderly,” Douglass said.

Stanley Katz, owner of Garden City Roofing and Insulation, said he thinks the new law will be a “good deal” and “keep a lot of riff-raff out.”

Katz also praised Douglass for the job he’s done as KRA president. “I think Steve does a good job of taking care of stuff of that nature,” he said.

Garden City Area Chamber of Commerce President Steve Dyer said he thinks the legislation will help “level the playing field” between the local contractors and those that come in after a disaster. Storms that do damage to roofs don’t come through often, but when they do “it’s crazy time.”

“It keeps everybody honest in business and encourages that everyone plays by the same rules,” Dyer said.

Dyer said local roofers will tell you they have picked up the pieces after a firm has come through to fix a roof. But insurance companies only pay for those repairs once.

Douglass said his company and a lumber business helped a woman who had been “bamboozled” when a storm came though in 2008. Douglass said his company donated the labor.

Other than legal means or filing a complaint against unscrupulous companies with the Better Business Bureau, the nearest of which is in Wichita, there is no other recourse for consumers, Dyer said.

“I’m definitely not saying there should be free enterprise, but everyone should have to do the same thing and jump through the same hoops,” Dyer said.

“One of the main reasons for this legislation is to protect consumers from unscrupulous contractors that swarm areas following a storm. Unfortunately, they appear in towns overnight, typically going door-to-door, overstating the need for immediate roof repairs and/or replacements. They sometimes require hefty deposits and use unprofessional tactics on people who are already anxious and unsure of what to do. Too often, the results are not good,” KRA Executive Director Kim Swartzendruber said in an email to The Telegram.

The KRA has been working on this type of legislation for two years, Swartzendruber said. “I’m pleased to see that home and building owners will have a way to reassure themselves that the company they plan to work with has some history, is adhering to typical company requirements (general liability, employee protection via workers’ compensation insurance), etc.,” Swartzendruber said.

She noted it will help promote professionalism in the roofing industry. “It will help to level the playing field if all companies are required to have insurance and pay appropriate taxes to the state of Kansas, Swartzendruber said.

“Though people can always find ways to be devious if that is their intent, we believe the Registry requirement will help to deter that type of company from coming into our communities,” she wrote. “There are very good Kansas and out-of-state contractors that perform work following storms, the hope is that having all companies register, will provide consumers a level of protection against the unscrupulous ones. A consumer will be able to check a website (operated by the Attorney General’s office) to determine if a company is registered appropriately to do business in Kansas.

The states surrounding Kansas have already implemented similar type laws or requirements. We believe this made Kansas an easy ‘target,’” Swartzendruber wrote.

FRASER, Mich. (WXYZ) – A 69-year-old Fraser woman just wanted a leaky roof fixed…last November. She called the Call For Action Team, and we got involved – not once…but twice.

“In the middle of the roof right there you can see it going down,” said Cathy Bacon pointing to a ripple-like effect in some of her shingles.

It was a week ago when she showed us what concerned her about the roofing project at her home. She also was upset about an unfinished gutter and some roofing trash left behind.

“My son…went up there, and he got all these nails that were loose,” she said while pouring out some nails she’d found and saved in a pill bottle.

The problem started last fall when her roof was leaking.

The unemployed senior had been approved for emergency relief assistance from the Department of Human Services for a new roof.

Bacon paid her portion in November.

But the state didn’t cut the roofer a check until March .

After he finally got his money, Bacon says he still did not show up.

So, she turned to our Call For Action team to prompt him to finish the job.

And once it was done, her son Mike — a medical supply salesman who used to do roofing — pointed out where he suspected bad wood had not been replaced.

“Right here I can feel like the wood has already given way.” Said Mike Bacon while he stepped on a portion of roof that appeared to be sinking slightly.

So, I called the roofer. I asked him to return to finish the job and to make sure the Bacons were 100% happy with his work.

A week later I came to see Cathy and to check on the work.

The gutter was fixed, the project’s trash was gone, and the Bacons say the roof had been shored up.

“Everything seems to be fine. And he told me that if I have any trouble with that roof I was to call him,” explained Ms. Bacon.

The new roof is under a 15-year warranty.

”I appreciate what you did for me. You guys are wonderful,” added Bacon.

If you have a consumer issue, maybe our Call For Action team can help you.

The attorneys general of Illinois, Kansas and Ohio are targeting storm-chasing roofing companies in their states with legal actions.

Illinois Attorney General Lisa Madigan filed a lawsuit against a Chicago-area home repair firm for allegedly failing to complete contracted projects and for failing to pay its supplier, resulting in thousands of dollars of liens put on customers’ homes.

The lawsuit against Perfect Restorations, based in Antioch, and company owners James Novack, James Hauser and Bruce Faber alleges the company required homeowners to make upfront installment payments ranging from $4,000 to $41,000, but when the contractors did incomplete or shoddy work, they refused to refund consumers.

Madigan also alleged that Perfect Restorations falsely operated as an insurance adjuster, negotiating damage claims with insurance companies on behalf of homeowners though the company was not licensed to do so.

In Kansas, Attorney General Derek Schmidt secured $50,000 in restitution from a Colorado roofing company accused taking down payments from at least six Kansas consumers but never performing any work on the consumers’ roofs.

All Trades Construction, also known as Duran Duran Roofing, and Louisa Duran were accused of violating the Kansas Consumer Protection Act by taking down payments on the work they did not perform. The AG also alleged that All Trades Construction and Luisa Duran forged one consumer’s signature on an insurance proceeds check.

Schmidt obtained a judgment in Shawnee County District Court ordering the company and Duran to repay a total of $50,954 to Kansas consumers and to pay an $80,000 civil penalty, the AG’s office said. The judgment also enjoins the company and Duran from further violations of the Kansas Consumer Protection Act.

Beginning July 1, roofing contractors will be required to register with the Attorney General’s Office, pursuant to the Kansas Roofing Registration Act recently approved by the Legislature and signed into law by Gov. Sam Brownback.

In Ohio, Attorney General Mike DeWine filed a lawsuit charging Restore It USA, LLC and its owner James Twaddle with multiple violations of Ohio’s consumer laws. According to the lawsuit, the business targeted consumers whose homes were damaged by storms but failed to deliver promised services.

Restore It USA is located at 1323 Brice Road in Reynoldsburg, the AG’s office said. It used a website called HailWatch to locate storm-ravaged counties and then solicited consumers at their homes, requesting their insurance money in exchange for new roofs.

According to the lawsuit, the business often failed to complete the promised work or failed to provide a refund, and it routinely failed to return consumers’ phone calls. It also entered into transactions knowing it did not have enough funds to complete contracted jobs.

The AG’s office said it is aware of 28 complaints against the business from Ohio consumers, whose losses total more than $65,000. Additional consumers likely have been affected.

The lawsuit seeks consumer restitution, civil penalties and injunctive relief.

More than one million square metres of asbestos roofing have to be cleared and disposed of by 2016, an exercise that will cost both government and the private sector an estimated Rwf23b.

Eradicating the material not only requires logistical support, but also specialised experts to ensure that the toxic substance is handled in a way that will not harm human life.

Rwanda Housing Authority (RHA), which is spearheading the exercise, says several people from construction enterprises, civil society, Police and inmates have been trained to do the work.

“Those are the only people who have the mandate to remove, transport and bury asbestos in designated areas,” said Eric Kananga, the in charge of asbestos eradication in RHA.

Kananga was addressing technicians at the 5th training on asbestos eradication in Kigali at the weekend. About 2,000 personnel have been trained. The government has so far disposed of 13 per cent of asbestos since 2011.

Budget constraints:

Efforts to eradicate asbestos started in October 2009, when Cabinet gave a six-month period within which people or institutions with asbestos on their roofs should have got rid of them.

However, this deadline was not met. RHA is decrying budgetary constraints.

“The budget is still a challenge, given that individuals say they do not have enough money to replace the asbestos,” Kananga said.

As far as public structures, which include public hospitals, schools and government buildings are concerned, institutions and districts are looking at the government treasury.

“Technicians are now available; all we are waiting for is money to pay them. Since most of the houses are public buildings, we are expecting State budget to cater for the exerciser,” said Solange Mukasonga, the mayor of Nyarugenge District.

She said they are sensitising the private sector on the dangers of asbestos so that they appreciate the urgency of the exercise.

Bishop Smaragde Mbonyintege, the spokesperson for the Catholic Church, which has a biggest number of asbestos roofs after the public sector, told The New Times that government has a big role to play in the activity because those who used asbestos did it legitimately.

“We asked for incentives for the exercise. We recognise it is in good faith that we have to get rid of asbestos but we asked government for help,” he said.

Only public institutions are certain to receive government support.

reported second-quarter 2013 adjusted loss per share of 2 cents, compared with earnings per share of 7 cents earned in the year-ago quarter, falling short of the Zacks Consensus Estimate of $0.00 per share or break even result.

The quarter results were affected by tough weather conditions in many of Beacons’ markets and higher operating expenses, partially offset by the impact from higher gross profit and lower interest expense.

The adjusted loss for the second quarter came after consideration of the $1.3 million credit to interest expense (or $0.8 million net of taxes) resulting from adjustments in the fair values of certain interest rate derivatives. Without this the second quarter loss per share was 0 cents compared to income per share of 7 cents in 2012.

Operational Update

Total revenue increased 5% year over year to $416.3 million, a second quarter record though it missed the Zacks Consensus Estimate of $429 million. Organic sales declined 5.1% in the quarter. In existing markets, non-residential roofing product sales declined 11.5%, complementary product sales increased 3.2% and residential roofing products dipped 1.4%. The current quarter benefited from the positive impact of several acquisitions completed since the start of last year.

Cost of goods sold increased 5% to $316 million in the quarter. Gross profit rose 6% to $99.6 million. Gross margin expanded 20 basis points to 23.9% from the year-ago quarter. Operating income in the reported quarter decreased 80% to $1.9 million with operating margin sliding 200 basis points to 0.5%.

Financial Position

Cash and cash equivalents declined to $16 million as of Mar 31, 2013 from $171 million as of Mar 31, 2012, mainly due to debt repayments this year and acquisitions. Total debt amounted to $221 million as of Mar 31, 2013, compared with $310 million as of Mar 31, 2012. Debt-to-capitalization ratio improved to 29.6% as of Mar 31, 2013 from 35.3% as of Mar 31, 2012.

Cash flow from operating activities declined to $20.6 million during the quarter from $80.3 million in the prior-year quarter due to less favorable changes in working capital, including additional inventory purchases made in 2013 ahead of announced price increases.

Outlook

For 2013, Beacon Roofing estimates earnings per share to lie in the range of $1.75 to $1.85. Re-roofing continues to dominate a large share of the roofing market, amounting to over 80%.

Our Take

Beacon Roofing’s acquisition pipeline remains active and we expect the acquisitions to continue at an accelerated pace in the near term. Moreover, both residential and non-residential construction sectors are showing signs of improvement, which bodes well for the company.

Furthermore, over 80% of expenditures in the roofing market are for re-roofing projects, with the balance being for new construction. Demand for re-roofing is also on the rise providing ample scope for Beacon to expand in this market. Furthermore, the company will benefit from the pent up repair work for both residential and non-residential demand and due to the harsher winter witnessed.

Beacon is one of the three largest roofing material distributors in the United States and Canada, with more than 90% of sales coming from the U.S. Beacon Roofing currently maintains a short term Zacks Rank #3 (Hold).

Oher stocks in the same industry with a favorable Zacks Rank are Lumber Liquidators Holdings, Inc. (

YUMA – It’s no mystery to Kelly Curtis what happened to the lumber used to build Jabba the Hutt’s sand barge filmed in the sand dunes for a segment in “Star Wars Episode VI: Return of the Jedi.”

A lot of it is in the roof of his house.

“What do you mean, you don’t know where the wood went?” Curtis recalled thinking when an article about the sand barge was published in a special section of the Yuma Sun commemorating the 30th anniversary of Yuma’s “Return of the Jedi” experience.

“It’s at 3182 W. Iron Drive.”

Curtis related how that came about.

After filming of the segment was completed in the spring of 1982, a local company was contracted to dismantle the set and dispose of the salvaged materials. One of the contractors was Austin Johnson, a friend of Curtis’ father. At the time, the Curtis family, including the four boys and their father, was building an adobe house.

“We needed long lengths of lumber to finish the roof and didn’t have much money at the time,” he recalled. “We ended up purchasing a couple of trailers full of the beams and plywood, using it in our roof.”

Asked what they paid for the salvaged material, Curtis said he didn’t know – he was 10 years old at the time.

He does know, though, “With my dad, it had to be a smoking deal.”

The timing was perfect as the family needed roofing materials. The house is 4,300 square feet, so it took the large sections of plywood and other materials from the sand barge to cover the big space, Curtis said.

“I remember taking the wood off the trailers and putting it on the roof. It didn’t sit around.”

Today Curtis owns the house, behind Ironwood Golf Course, and is proud of it.

“I have the ‘Star Wars’ house,” he said. “As a kid, it was a big deal that I got the Jedi house.

“Needless to say my house was popular with my friends. Every time the movie came up, I could say the roof of my house was from it.”

Today, with the “Star Wars” resurgence, his children have the same bragging rights.

“It’s like having a famous uncle,” Curtis said.

He also recalled being in the audience when the movie opened. When the sand dunes scene came up, there was a big cheer.

“So many people in Yuma worked on it. It was a big deal.”

The Yuma Sun also received reports that plywood from the set went to several other houses, and many horse corrals in Yuma were built with wood salvaged from the movie set.

Some of the large beams used to support the sand barge 20 feet in the air went into construction of the restaurant at Martinez Lake, Johnson recalled.

“All the material was top-of- the-line,” he said. “It was all first-class materials.”

He said he partnered with Frank Amavisca to remove the materials from the set.

They were paid $20,000 in addition to whatever money they received for selling the salvaged materials.

It was good deal for those who purchased the wood, as the contractors “knocked 50 to 80 percent off the new price.”

Beacon Roofing Supply Inc., a building materials distributor based in Peabody, reported a small fiscal second-quarter loss, as harsh weather conditions in many of its markets reduced sales.

Beacon said the recent quarter was a tough one as a result of rough winter and spring weather conditions and comparisons to a prior-year period when sales to existing markets jumped 28 percent.

For the quarter ended March 31, the company lost $161,000, or breakeven on a per share basis, compared with net income of $3.1 million, or 7 cents per share, in the year-ago quarter.

Excluding one-time items, the company said it posted an adjusted loss of 2 cents per share.

FRASER, Mich. (WXYZ) – Cathy Bacon’s roofer started working on her leaky roof last November. When the job was still not finished almost six months later, she called the Call For Action team for help.

“It was leaking in the kitchen,” explained Bacon.

The unemployed 69-year-old could not afford it.

So she applied to the Michigan Department of Human Services for Assistance.

The Department approved an estimate from a roofer who had knocked on her door after seeing missing shingles.

“He said he did good work, and he said he’d get the job done 1, 2, 3,” she recalled.

The roofer started the job in November after Bacon paid him her portion.

But she says he didn’t finish the work for months because he was waiting for his check from Human Services.

Bacon says he still didn’t show up to finish the job when he did receive the money.

“I called for action when he didn’t show up. He got his money. And he didn’t show up to finish the roof,” said Bacon.

After our Call For Action volunteers contacted the roofer, she says he returned in April.

He finished the shingles, but he didn’t complete the gutter work in the back of the home. He also left behind old shingles and splintered wood.

“My son – he went up there [on the roof] and got all these nails that were loose,” said Bacon pouring out the nails she kept in a bottle.

When he was on the roof, Mike Bacon discovered another concern.

“In the middle of the roof right there, you can see it going down,” she said pointing to a subtle dip or two in shingles.

Her son Mike – a medical supply salesman who used to do roofing – showed us where he believes bad wood was not replaced.

“Right here I can feel like wood has already given way,” said Mike Bacon as he stepped on some portions of the newly shingled roof that dipped slightly.

At the top of the work proposal, the roofer agreed to replace all bad wood on the roof deck.

So I talked with the roofer on the phone to explain the Bacons’ concerns.

The roofer agreed to come back to the home to fix any problems and ensure that the Bacons are 100-percent happy with his work.

We set a schedule, and the 7 Action News’s Call For Action team will be watching.

If you have a consumer complaint, you can reach the Call For Action team by phone at (248) 827-3362 from 11:30 a.m. – 1:30 p.m. on Mondays, Tuesdays, and Wednesdays. You may also email your complaints here.

Release: TOPEKA – (May 8, 2013) – A Colorado roofing company has been ordered to repay more than $50,000 to Kansas consumers, Attorney General Derek Schmidt announced today.

All Trades Construction, also known as Duran Duran Roofing, and Louisa Duran were accused of violating the Kansas Consumer Protection Act by taking down payments from at least six Kansas consumers but never performing any work on the consumers’ roofs. The Attorney General also alleged that All Trades Construction and Luisa Duran forged one consumer’s signature on an insurance proceeds check.

“Taking payment for services that are never performed is unlawful,” Schmidt said. “Consumers should be cautions when dealing with contractors selling their services door-to-door and should remember that under Kansas law they have a three-day right to cancel.”

The Attorney General obtained a judgment in Shawnee County District Court ordering the company and Duran to repay a total of $50,954 to Kansas consumers and to pay an $80,000 civil penalty. The judgment also enjoins the company and Duran from further violations of the Kansas Consumer Protection Act.

Schmidt reminded Kansans that it is usually best to work with a trusted, local contractor when home repairs are required. They should be sure the company they are working with has the required local permits and insurance. Beginning July 1, roofing contractors will also be required to register with the Attorney General’s Office, pursuant to the Kansas Roofing Registration Act recently approved by the Legislature and signed into law by Governor Brownback.

Kansans who may have been a victim of a scam or unlawful door-to-door sales practice should contact the Attorney General’s Consumer Protection Division at (800) 432-2310 or www.ag.ks.gov.

When I wrote about using coconut coir as a soil amendment, commenter Ruben suggested I should look closer to home for organic matter that originates from my own bioregion.

Whether or not my defense—that I was using up a waste product that is readily available and relatively efficiently shipped—holds any water will depend on your perspective on sustainability (and the path to getting us there), but there’s little doubt that my paltry efforts are reducing my own impact pale into insignificance compared to people who REALLY know how to use a coconut.

As one of the latest episodes from The Perennial Plate—the people who brought us video of urban farmers and brass bands in New Orleans, and cows retiring in Iowa—demonstrates, the idea of coconut coir as a waste product is a bit of an anathema to the small scale coconut farmers whose families have been growing this crop for generations.

From roofing materials to firewood to rope to a natural alcoholic beverage harvested from the flowers, Sri Lankan farmers have learned to use almost every single part of the tree. If every farmer farmed like this, I doubt there’d be much coir left over to ship over to me for my soil amendments.

Ruben will be pleased to know that my leaf mulch pile is well on its way to being ready for use.

This year’s recipient is Ms. Jessie Hunt McGree of Dallas and the roof she will be receiving is valued in the $10,000 to $12,000 range. The kick-off for the new roof installation will begin at 9 a.m. on May 10 at 208 W. Main St., in Dallas.

“Giving back to the community has always been a top priority at Hatley Brothers II Roofing Construction,” said Ke’Elronn Hatley, owner, Hatley Brothers II Roofing Construction. “In Texas, homeowners are often faced with the financial burden of replacing roofs more frequently than some other geographic locations due to hail and wind damage, extreme heat and general age deterioration. In this current economic climate, with the average cost of residential roof replacement services running anywhere from $10,000 to $15,000, we knew we had to do something to make a difference in the community. So we decided to help someone in need by providing them with a new roof at no charge, and we are looking forward to installing Ms. McGree’s special Mother’s Day gift.”

This is an update of a story originally posted at 1:02 a.m. Friday

WESTFIELD - Investigators with the Westfield Fire Department and the state Fire Marshal’s Office were still working to determine the cause of a Thursday night fire that destroyed a fabrication building at Westfield Truss, 100 Apremont Way, officials said.

Jennifer L. Mieth, spokeswoman for state Fire Marshal Stephen D. Coan, said that on Friday afternoon investigators were using heavy equipment to dig through the rubble at the site in hopes of finding where the fire started.

“It’s way too early to discuss a cause,” she said.

The fire swept through the building, burning it to the ground before the flames could be extinguished. When firefighters arrived on scene about 9:30 p.m., the structure was fully engulfed, said Deputy Chief Mark Devine of the Westfield Fire Department.

Western Mass Truss Company manufactures wooden prefabricated structural support systems for roof and flooring structures. Much of the fuel for the fire was lumber used in making those trusses, he said.

Devine declared the building a total loss.

Damage was not limited to the Western Mass Truss Company property, Devine said. Embers from the blaze were swept some 200 yards to start a small fire that damaged a storage building belonging to Martin Floor Covering on Southampton Road.

Devine said some 25 firefighters and eight pieces of firefighting apparatus were used in battling the blaze. Additional units from Agawam and Southwick provided backup service to Westfield.
